Young boy dies after doctor fails to diagnose disorder

Parents go to extreme measures to make sure that their children are born healthy. Mothers in New York may cut back on certain foods, give up caffeine and start taking prenatal vitamins. Precautionary efforts, however, are all lost if a mother’s doctor fails to diagnose conditions that could be dangerous to the health of the mom and baby.
A couple in another state lost their 2-year-old son and have now filed a lawsuit against a hospital in the couple’s area. The young boy was born early and suffered through many medical issues before passing away. The boy’s parents say that his death was the result of the doctor’s failure to diagnose his APS condition. APS, or Antiphospholipid Antibody Syndrome, can be a deadly autoimmune disorder. The disease can create complications during pregnancy and death is usually caused by large blood clots. There are treatments available and the disorder does not have to be fatal.
The couple filed a wrongful death and malpractice lawsuit against the hospital where the doctor worked. The boy’s mother suffered from APS but the lawsuit claims her doctor did not take this into consideration during her pregnancy. The parents claim that their child should have received treatment for the disorder but that the doctor never made the diagnosis.
Doctors in all practice areas are held to an accepted standard of care. This standard applies during treatments and procedures and even when a doctor makes a diagnosis. Failure to diagnose a condition or disease can have serious or even deadly consequences. For example, a delayed diagnosis for some cancer patients could be the difference between life and death. If someone seeking medical care suffers due to a doctor’s misdiagnosis, the patient, or the family of a departed loved one may be able to recover compensation for the injury through a medical malpractice suit with the help of a New York failure to diagnose cancer lawyer.
